The Buyer(s) agrees to the following:

     1.      To meet in full all terms and conditions of the sale.

     2.      Buyer(s) will not use in or sell the above described puppy to a puppy farm or puppy mill, as that term is commonly defined or described by the

              American Kennel Club.

     3.      The above described puppy shall not be used or donated for the purpose of use for medical, veterinary, or scientific research, experimentation

              or field testing, without the express written consent of Breeder.

     4.      Buyer(s) agrees to assume responsibility for all veterinary care, whether routine or emergency, from the moment the Buyer(s) has the above

              described puppy in the Buyers or Buyers designated agent’s possession. Buyer(s) is encouraged to have annual eye examinations and at the

              age of two (2) to have the dogs’ hips x-rayed and certified by the OFA. Buyer(s) is also encouraged to have elbows and thyroid clearances

              done.

     5.      Buyer(s) agrees to feed and exercise the puppy carefully for the first year, keep the puppies weight within normal limits, refrain from over

              exercising the puppy, and prohibit the puppy from injuring him/herself.

     6.      Breeder highly recommends attending training classes and socialization sessions, especially during the first year.

The Breeder agrees to the following:

     1.      Breeder guarantees the above described puppy will be in good health when departing from breeders’ possession to the best of their

              knowledge. Breeder further guarantees the puppy to have been de-wormed, dew claws removed, and first set of vaccinations given.

     2.      Breeder guarantees the puppy to Orthopedic Foundation of America (OFA) hip certification with a rating of “Fair” after the puppy has reached

              two (2) years of age as long as the Buyer(s) can show that the Buyer(s) have complied with the puppy instructions outlined in paragraph 5 of

              the Buyer Agreement. No claims of dysplasia will be considered without proper documentation from OFA made available to Breeder and

              Breeders veterinarian. If the puppy is found to be dysplastic, Breeder will replace the dog with another puppy of equal value when available.

Health Guarantee

This puppy is the product of two purebred AKC and/or ASCA registered Australian Shepherd parents without any visible health problems or know hereditary conditions and is guaranteed to be in good health and free from communicable disease at the time of sale. It is highly recommended to take your new puppy to a Doctor of Veterinary Medicine (DVM) within 72 hours of pickup for a health examination, at your expense, if you so desire. If, at that time, it is found that your new puppy is not in good health or has a communicable disease, a full refund will be returned to you in exchange for the puppy, at the Buyers expense, and a report from the DVM listing reasons for the return. Report MUST include DVM’s contact information.

Health guarantee does not cover any parasite, internal or external, as these are common treatable conditions in puppies and dogs. Third party sale makes this contract null and void as does evidence of abuse, neglect, or accident. Breeder will not be responsible for injury or accident to puppy, or cost for repair, once s/he leaves my care. In addition, I make no guarantee on eye color, earset, size, working ability, or reproductive ability of puppy. Furthermore, puppies WILL require medical attention at some point during their lifetime. Do not make this purchase if you are not prepared to pay vet expenses as all vet expenses will be Buyers responsibility from this point forward. Do not make this purchase if you believe this puppy is not in good health at the time of sale. Buyer has been informed puppy has recently been de-wormed and worms may be present in the stool as wormer is designed to rid the intestinal tract of parasites. Buyer should also be aware that vaccinated puppies are still susceptible to contagious disease though every effort has been made to prevent this unfortunate occurrence. No other guarantees expressed or implied.

Buyer has decided to purchase the above described puppy and has left a down payment on said puppy. Buyer agrees to pay the remaining balance before the puppy goes home. Breeder will continue to feed, worm, play with, and care for said puppy until the puppy reaches 8 (eight) weeks of age, unless other agreements are agreed to. At that time, Buyer agrees to assume all veterinary responsibility for the puppy, as well as all other care required. Breeder will vaccinate puppy at seven (7) weeks of age, at Breeders expense.

In the event Buyer decides to purchase a different puppy, the deposit can be transferred to another puppy that is not already spoken for. If the Buyer decides to not purchase a puppy from the Breeder, no refund will be given to the Buyer.

Stud Dog Contract

This agreement is entered into on the __________ day of _________________________________ 20_________ between stud dog owner, Jessica Bates (hereafter referred to as dog owner), and bitch owner, __________________________________________________________ (hereafter referred to as bitch owner).

The stud fee for the below described dog is $900.00, which will be paid in full before AKC/ASCA registration papers will be signed. _________ (SDO) __________ (BO)

The stud fee of $900.00 for the below described dog may be substituted for one puppy from the resulting litter, with the stud dog owner having the second pick of puppies, behind the bitch owner, if there is a puppy stud dog owner deems show quality. __________(SDO) __________(BO)

All the stud dogs’ health testing paperwork will be copied, and supplied to the bitch owner. One copy of the bitches’ health testing paperwork will be supplied to the stud dog owner. __________(SDO) _________(BO)

When the puppies are 6 -7 weeks old, stud dog owner will meet bitch owner at bitch owners’ veterinarian on the 6th or 7th Saturday. Both people will be in the room for exam, which is the financial responsibility of the bitch owner. If a puppy is being used as stud fee, the puppy will be chosen then and paperwork will be signed. The Buyer agrees to the following:

     1.      To meet in full all terms and conditions of the sale.

     2.      The above described animal is being retired from Sellers breeding program. Buyer agrees to have said animal spayed/neutered, if not already 

              done by Seller, within 60 days of purchase.

     3.      The above described animal shall not be used or donated for the purpose of use for medical, veterinary, or scientific research, experimentation

              or field testing, without the express written consent of Seller.

     4.      Buyer agrees to assume responsibility for all veterinary care, whether routine or emergency, from the moment the Buyer has the above

              described animal in the Buyers or Buyers designated agent’s possession.

     5.      Buyer agrees to properly feed and exercise, as well as provide proper physical and mental care for the animal from the moment the animal is

              in the Buyers possession, per breed requirements.

Seller guarantees the above described animal to be in good health when departing from Sellers possession to the best of their knowledge. Seller further agrees the animal has been dewormed and has had dew claws removed. This animal is being sold as a companion animal only, and therefore must be spayed/neutered within 60 days of signing this contract, if not already done by Seller. This animal has been an out-door dog, house-broken is not a guarantee.
